New Hamsphire's Current Requirements

In New Hampshire we have several very progressvie animal welfare statutes including:
RSA 644:8, which makes it a Class B felony to purposefully torture or mutilate an animal

RSA 644:8aa which allows law enforcement officers to break into a motor vehicle to rescue an animal suffering from extreme heat or cold.

RSA 644:8f which provides safeguards for dogs transported in pick-up trucks

RSA 437:22 which prohibits animal shelters from giving or selling animals for the purpose of experimentation or vivisection

However, our requirement for necessary shelter for dogs belongs in the 15th century! Currently, the only standards for necessary dog shelter are included in RSA 644:8, our animal cruelty statute, and are as follows:

"In this section, "shelter" or "necessary shelter" for dogs shall mean any natural or artificial area which provides protection from direct sunllight when that sunlight is likely to cause heat exhaustion of a dog tied or caged outside. Shelter from inclement weather shall have an area within to afford the dog the ability to stand up, turn around and lie down, and be of proportionate size to allow the natural body heat of the dog to be retained."

Many other states, have passed laws with very specific standards for shelter for "outside dogs," but here in the Granite State we don't even guarantee our beloved canine friends protections against wind, rain, snow, heat or cold.
